Welcome to Plamedi Luxury Stay. These Terms and Conditions govern all reservations, stays, and interactions with our properties across Johannesburg and Cape Town. They have been drafted in alignment with the standards upheld by South Africa’s finest luxury hospitality establishments and in full compliance with South African consumer and privacy legislation. Please read them carefully before confirming your reservation — making a booking constitutes full acceptance of these Terms.

Definitions & Interpretation
How key terms are used throughout this document

In these Terms and Conditions, the following words and expressions shall bear the meanings ascribed to them below, and cognate expressions shall bear corresponding meanings:

  • “Company” means Plamedi Trading CC, a Close Corporation duly registered in accordance with the laws of the Republic of South Africa, being the registered owner and operator of the Plamedi Luxury Stay brand and all associated properties.
  • “Plamedi Luxury Stay” / “we” / “us” / “our” refers to the hospitality division of Plamedi Trading CC, operating luxury short-term holiday accommodations in Johannesburg (Gauteng) and Cape Town (Western Cape), South Africa.
  • “Guest” / “you” / “your” means any individual, group, couple, family, or legal entity that makes, or is named on, a reservation, or that occupies any of our Properties during a Stay, including all accompanying persons.
  • “Lead Guest” means the person in whose name the Booking is made and who bears primary legal responsibility for compliance with these Terms and for all charges incurred during the Stay.
  • “Property” / “Accommodation” refers to any room, suite, apartment, villa, or unit owned, leased, or managed by Plamedi Luxury Stay, including all common areas, amenities, gardens, parking, and facilities associated therewith.
  • “Booking” / “Reservation” means a confirmed accommodation request made through any Authorised Channel — whether direct, online, telephonic, or via a Third-Party Platform — together with any ancillary services booked in connection therewith.
  • “Authorised Channel” means our official website (www.plamedistays.com), our direct reservations email or telephone line, or any Third-Party Platform with which we maintain a formal listing agreement.
  • “Booking Confirmation” means the written communication (email or document) issued by Plamedi Luxury Stay confirming the acceptance of a Booking, including the booking reference number, dates, property, total amount, and applicable terms.
  • “Stay Period” means the entire period commencing at Check-in and concluding at Check-out as specified in the Booking Confirmation.
  • “Total Booking Amount” means the full amount payable, inclusive of accommodation charges, applicable seasonal supplements, cleaning fees, VAT, and any pre-agreed ancillary services.
  • “Third-Party Platform” means any external online travel agency or booking platform, including but not limited to Airbnb, Booking.com, Expedia, and similar services.
  • “Force Majeure Event” means any event or circumstance beyond the reasonable control of either party, as more fully described in Section 17 of these Terms.
  • “SAST” means South African Standard Time (UTC+2), the time zone applicable to all operational matters at our properties.

Words importing the singular shall include the plural and vice versa. Headings are for reference only and shall not affect interpretation. References to any legislation include all amendments thereto.

Acceptance & Eligibility
Who may make a booking and on what basis

By completing a Booking — whether online, telephonically, by email, or through a Third-Party Platform — you represent, warrant, and confirm that:

  • You are at least 18 years of age and possess full legal capacity to enter into a binding agreement.
  • You have read, understood, and agree to be unconditionally bound by these Terms and Conditions in their entirety, including any Property-specific house rules communicated to you.
  • Where you are booking on behalf of a group, you accept these Terms on behalf of all members of your party and accept personal responsibility for ensuring their full compliance throughout the Stay.
  • All information provided in connection with the Booking is accurate, complete, and truthful.
  • You are not making the Booking for any purpose that is unlawful, or contrary to these Terms or any applicable law of the Republic of South Africa.

These Terms constitute a legally binding agreement between you and Plamedi Trading CC (trading as Plamedi Luxury Stay). Your statutory rights as a consumer under the Consumer Protection Act 68 of 2008 are not diminished or excluded by any provision of these Terms. If any provision conflicts with your statutory rights, your statutory rights shall prevail to the extent of the conflict.

Plamedi Luxury Stay reserves the right to decline a Booking at its sole discretion, without being required to furnish reasons. In the event a Booking is declined after payment has been received, a full refund will be processed within 7 business days.

Reservations & Confirmation
How a booking becomes binding

All Bookings are subject to availability. A Booking is only considered confirmed and binding upon the simultaneous occurrence of the following:

  • Receipt of payment: Receipt by Plamedi Luxury Stay of the required deposit or full payment as specified during the booking process.
  • Issuance of Booking Confirmation: Dispatch of a written Booking Confirmation to the Lead Guest’s registered email address containing a unique booking reference number.

The Lead Guest is solely responsible for verifying the accuracy of all details in the Booking Confirmation, including the property, check-in and check-out dates, number of guests, and total amount. Any discrepancies must be reported within 24 hours of receipt of the Booking Confirmation.

  • Reconfirmation: Consistent with the standard of service provided by leading South African luxury establishments, Guests are encouraged to reconfirm their arrival time with our reservations team at least 48 hours prior to Check-in, particularly where special requests or arrangements have been made.
  • Modifications: Requests to modify a confirmed Booking (change of dates, property, or guest numbers) are subject to availability and may be subject to rate differences or a modification fee. All modifications must be submitted in writing to booking@plamedistays.com.
  • Prohibited transfers: Bookings are personal to the Lead Guest. Sub-letting, resale, or transfer of a Booking to any third party without prior written consent from Plamedi Luxury Stay is strictly prohibited and shall render the Booking void without refund.
  • Minimum stay: Certain properties or dates may require a minimum stay period. This will be communicated during the booking process and confirmed in your Booking Confirmation. Peak season properties in Cape Town may carry a minimum stay of 3 to 7 nights.
  • Waiting list: Where a requested property is unavailable, Guests may request placement on a waiting list. Plamedi Luxury Stay will contact the Guest in the event a suitable vacancy arises but makes no guarantee of availability.

Rates, Pricing & Seasons
How we price our accommodations

All rates published on our website and communicated during the booking process are denominated in South African Rand (ZAR) and are inclusive of Value Added Tax (VAT) at the current statutory rate of 15%, unless explicitly stated otherwise.

  • Rate integrity: The rate confirmed at the time of Booking shall be honoured for that Booking, even if subsequently amended on our website. Plamedi Luxury Stay reserves the right to update published rates at any time without prior notice, with effect from the date of update for new Bookings only.
  • What is included: Unless otherwise specified, the nightly rate includes standard accommodation, high-speed Wi-Fi, and any inclusions detailed in your Booking Confirmation (e.g. breakfast, welcome amenity). Items such as parking, transfers, spa treatments, and in-room extras are charged separately unless forming part of a specified package.
  • Weekend premium: A weekend premium supplement applies to Friday and Saturday nights at certain properties. This will be clearly disclosed prior to booking confirmation.
  • Foreign currency: Plamedi Luxury Stay transacts exclusively in ZAR. Guests paying via international payment methods bear sole responsibility for any exchange rate fluctuations, foreign transaction fees, or bank charges.
  • Tax invoices: VAT invoices are available upon request and will reflect Plamedi Trading CC as the registered taxable entity with the applicable CC and VAT registration numbers.

  • Accepted payment methods: We accept PayFast (EFT, Instant EFT, Mastercard, Visa), PayPal, and direct Electronic Funds Transfer (EFT) by prior arrangement. All online card transactions are secured by industry-standard SSL encryption. We do not store card details.
  • Failed payments: Where a balance payment fails or is not received by the due date, Plamedi Luxury Stay reserves the right to release the reservation without further notice. Plamedi Luxury Stay will make reasonable attempts to contact the Lead Guest prior to releasing the booking.
  • Incidental charges: A credit card or debit card pre-authorisation for incidental charges (in addition to the security deposit) may be required at check-in. Any incidental charges incurred during the Stay will be billed upon check-out.
  • Invoicing: A provisional invoice will be issued upon Booking Confirmation. A final tax invoice will be issued upon check-out reflecting all charges incurred during the Stay.

All payments are processed through PCI DSS-compliant payment gateways. Plamedi Luxury Stay does not store, process, or have access to your full card details at any point in the transaction process.

Cancellation & Refund Policy
Our tiered cancellation framework by notice period

Plamedi Luxury Stay understands that travel plans may change. The following cancellation policy applies to all direct Bookings. We strongly advise all Guests to arrange comprehensive travel insurance that includes trip cancellation and curtailment cover prior to travel.

  • Cancellation procedure: All cancellations must be submitted in writing to booking@plamedistays.com. The cancellation date shall be the date on which written acknowledgement of the cancellation is issued by Plamedi Luxury Stay — not the date of the Guest’s written request. Verbal cancellations will not be accepted.
  • Refund method: Approved refunds will be processed to the original payment method only. Plamedi Luxury Stay will not transfer refunds to a different account or third party.
  • Credit vouchers: At management’s discretion, a credit voucher valid for 12 months from the date of issue may be offered in lieu of a monetary refund, particularly in compassionate or exceptional circumstances.
  • Plamedi Luxury Stay cancellations: In the rare event that Plamedi Luxury Stay must cancel a confirmed Booking due to circumstances within our control (e.g. property becoming unavailable due to damage), the Guest will receive a full refund of all amounts paid and, where possible, will be offered alternative accommodation of equivalent or superior standard.

Travel Insurance: In alignment with the practices of South Africa’s leading luxury hotels, Plamedi Luxury Stay strongly recommends that all Guests obtain comprehensive travel insurance covering trip cancellation, curtailment, medical evacuation, loss of personal property, and personal liability. We are not able to waive our cancellation policy on account of uninsured personal circumstances.

Check-in & Check-out
Arrival, departure, and identification requirements

  • Valid photo ID required for all guests
  • Credit/debit card required for pre-authorisation
  • Booking Confirmation must be presented

Departure (Check-out)

  • Standard time: 11:00 SAST
  • Late check-out until 14:00: subject to availability
  • Late check-out until 14:00: 50% of nightly rate
  • Check-out after 14:00: full additional night charged
  • All keys/access cards to be returned
  • Itemised account to be settled before departure
  • Identification: All adult guests are required to present a valid, unexpired, government-issued photo identification document at check-in. Acceptable documents include a South African Identity Document, Passport, or Driver’s Licence. Non-South African nationals must present a valid Passport. Copies of identification may be retained in accordance with our obligations under South African law and our POPIA-compliant privacy policy.
  • Lead Guest presence: The Lead Guest must be present at check-in. Plamedi Luxury Stay reserves the right to refuse access to the property if the Lead Guest cannot be verified. A third party may check in on behalf of the Lead Guest only where prior written authorisation has been obtained from Plamedi Luxury Stay.
  • Early check-in: Early check-in prior to 14:00 SAST is strictly subject to property availability and must be pre-arranged with our reservations team. Where early check-in is confirmed, an early-check-in supplement of 50% of the nightly rate applies.
  • Arrivals pre-notification: In line with the practices of leading luxury properties, Guests are kindly requested to advise our reservations team of their estimated arrival time at least 24 hours before Check-in to ensure a warm, personalised welcome experience.
  • Access equipment: All keys, key cards, remote controls, parking tags, and access devices issued to the Guest must be returned in full and in working order at check-out. The cost of replacing lost, damaged, or unreturned items will be charged to the Guest’s account.

Guest Conduct & House Rules
Standards of behaviour expected at all Plamedi Luxury Stay properties

Our properties are private luxury residences curated for the enjoyment of discerning guests. We expect all guests to conduct themselves in a manner consistent with the exclusive nature of our accommodations and with respect for neighbouring residents, other guests, and our team.

Quiet Hours

Strictly enforced between 22:00 and 08:00 SAST. Noise, music, and entertainment must not disturb neighbours or adjacent properties during these hours.

Events & Gatherings

Parties, functions, and gatherings exceeding the booked occupancy are strictly prohibited without prior written approval. Unauthorised events will result in immediate termination of the Stay without refund.

Smoking Policy

All properties are 100% non-smoking indoors. Smoking is only permitted in designated outdoor areas. Indoor smoking violations attract a minimum deep-cleaning surcharge of R3,500.

Pets

Pets are not permitted unless the property listing expressly states otherwise and pet approval has been confirmed in writing. Undisclosed pets will result in an additional cleaning fee and may result in early termination of the Stay.

Visitors & Day Guests

Day visitors are welcome between 08:00 and 21:00 SAST only. Total occupancy (guests + visitors) must never exceed the property’s maximum. No overnight visitors permitted unless booked and paid for.

Unlawful Activity

Any activity in contravention of South African law — including but not limited to drug use, illegal gambling, or human trafficking — will result in immediate eviction, forfeiture of all funds paid, and reporting to authorities.

Property Care

Guests must treat all furnishings, artwork, appliances, and fittings with utmost care. Properties must be left in a reasonable state of cleanliness. Excessive cleaning beyond standard housekeeping will attract additional charges.

🌿

Sustainability

We ask all guests to support our environmental commitments: conserve water and electricity, follow waste separation instructions, and report maintenance issues to our team promptly.

Right to Refuse & Terminate: Plamedi Luxury Stay reserves the right to refuse check-in or to terminate a Stay with immediate effect — without refund — in the event of a material breach of these house rules or any conduct deemed to be threatening, abusive, or damaging to guests, staff, neighbours, or property. In such circumstances, the Guest will be required to vacate the property immediately.

Security Deposit
Pre-authorisation, deductions, and refund process

A refundable security deposit is required for all Bookings. The applicable deposit amount is specified in each property listing and is confirmed in the Booking Confirmation. The deposit is held as security against any damages, loss, excessive cleaning, or additional charges incurred during the Stay.

  • Collection: The security deposit may be collected by way of a credit card pre-authorisation or a separate EFT transfer at or before check-in. Pre-authorisations are not debits and do not represent an actual charge unless a claim is made.
  • Full refund: Where the property is returned in a satisfactory condition with no damage, loss, or additional charges, the security deposit (or pre-authorisation release) will be processed within 5 business days of check-out, following the completion of the post-checkout property inspection.
  • Deductions: In the event that deductions are warranted, Plamedi Luxury Stay will provide the Lead Guest with a written, itemised deduction schedule within 3 business days of check-out, together with supporting evidence (photographs, supplier invoices, or repair quotations where applicable). The balance of the deposit, if any, will be refunded thereafter.
  • Shortfall: Where the cost of damages or additional charges exceeds the security deposit amount, Plamedi Luxury Stay will issue a written demand to the Lead Guest for the balance outstanding. In the event of non-payment, we reserve the right to pursue recovery through civil legal channels.
  • Disputes: The Lead Guest has 5 business days from receipt of the deduction schedule to raise a written dispute. Plamedi Luxury Stay will review and respond to disputes within 10 business days of receipt.

Damage & Loss
Guest responsibility for property and contents
  • Guests are fully liable for any damage to the Property, its furnishings, artworks, appliances, fixtures, or fittings caused during the Stay Period — whether caused by the Lead Guest, members of their party, or any visitors admitted to the Property.
  • Damage will be assessed at the cost of professional repair or like-for-like replacement, including any associated labour, transport, and incidental costs. Plamedi Luxury Stay will obtain at least one independent quote where the cost of any single item exceeds R1,000.
  • Accidental damage should be reported to our team as soon as it occurs. The prompt reporting of accidental damage will be taken into consideration when assessing the Guest’s goodwill; however, it does not waive the Guest’s liability for the cost of repair or replacement.
  • Plamedi Luxury Stay is not liable for loss, theft, or damage to any Guest’s personal belongings, luggage, valuables, vehicles, or equipment during a Stay. Guests are strongly advised to secure their valuables and to ensure appropriate insurance cover is in place prior to arrival.

Amenities & Services
Use of property facilities and ancillary offerings
  • Amenity access: All amenities described in the property listing (e.g. pool, braai area, gym, parking) form part of the accommodation offering. Temporary unavailability of a specific amenity due to maintenance, weather, or safety reasons will not entitle the Guest to compensation or a reduction in the accommodation rate, provided reasonable alternatives are offered where practicable.
  • Pool safety: Swimming pools and water features, where present, are used entirely at the Guest’s own risk. Children must be supervised by a responsible adult at all times in and around pool areas. Plamedi Luxury Stay accepts no liability for aquatic incidents. Diving and running in pool areas is prohibited.
  • Housekeeping: Standard housekeeping is provided as described per property (typically daily or every second day for extended stays). Additional housekeeping services may be arranged at additional cost. Guests who decline housekeeping for more than 3 consecutive days may be requested to allow a welfare inspection of the property.
  • Concierge & curated experiences: Our reservations and concierge team is available to assist with restaurant recommendations, airport transfers, vehicle hire, guided tours, helicopter flights, spa bookings, and bespoke curated experiences across Johannesburg and Cape Town. Third-party service providers engaged through our concierge operate under their own terms and conditions.
  • Parking: Where parking is provided, it is offered as a complimentary convenience where stated. Plamedi Luxury Stay accepts no liability for damage to, theft from, or theft of any vehicle parked at its properties.
  • Utilities: South Africa is subject to intermittent load-shedding (scheduled power outages managed by Eskom). Plamedi Luxury Stay makes reasonable provision for load-shedding through backup power solutions at most properties; however, a full utility experience cannot be guaranteed during extended national grid outages beyond our control.

Accessibility & Special Needs
Accommodating guests with specific requirements

Plamedi Luxury Stay is committed to providing an inclusive and welcoming environment. Guests with accessibility requirements, disabilities, or specific medical needs are encouraged to communicate their requirements at the time of booking so that we may make every reasonable effort to accommodate them.

  • Accessible accommodation availability varies by property. Please enquire directly with our reservations team for detailed information on accessible features at specific properties in Johannesburg and Cape Town.
  • Special dietary requirements, medical equipment accommodation, cot and pram needs, and other personal requirements should be communicated at the time of booking. Plamedi Luxury Stay will make reasonable endeavours to meet all stated requirements, subject to feasibility.
  • Service animals assisting Guests with disabilities are welcome at all Plamedi Luxury Stay properties. Prior written notification is required at least 48 hours before Check-in. All service animals must remain under control at all times.

Children & Additional Occupants
Policies applicable to families and groups
  • Children: Children of all ages are welcome at Plamedi Luxury Stay properties. Children under the age of 12 sharing a room with parents or guardians using existing bedding may stay complimentary. Children 12 years and older are charged at the standard adult rate.
  • Cots: Travel cots are available for infants under 2 years of age, subject to availability, at no additional charge. One cot per accommodation unit, subject to advance request.
  • Child supervision: Children must be supervised by a responsible adult at all times within the property, particularly around pool areas, balconies, and external terraces. Plamedi Luxury Stay accepts no liability for incidents involving unsupervised children.
  • Maximum occupancy: The maximum number of guests (adults and children combined) permitted per property is as stated in the property listing and the Booking Confirmation. This limit is established for safety and regulatory compliance and may not be exceeded under any circumstances.
  • Child-minding services: Upon request and with at least 24 hours’ notice, Plamedi Luxury Stay may be able to assist in arranging vetted, professional child-minding services at an additional cost. This is subject to availability and is provided through accredited third-party service providers.

Limitation of Liability
The extent of our legal responsibility to guests

Our total aggregate liability to any Guest arising out of or in connection with any Stay or Booking shall, in any event, not exceed the Total Booking Amount paid in respect of the relevant Stay. Nothing in these Terms excludes or limits liability that cannot be excluded under South African law, including liability for gross negligence or wilful misconduct.

Privacy & Data Protection (POPIA)
How we collect, use, and protect your personal information

Plamedi Trading CC (trading as Plamedi Luxury Stay) is a Responsible Party as defined in the Protection of Personal Information Act 4 of 2013 (POPIA) and is committed to the lawful, transparent, and purpose-specific processing of all personal information.

  • Information collected: We collect personal information including full name, contact details (email, telephone, address), identification document details, payment information, booking history, dietary or accessibility preferences, and communications with our team.
  • Purpose of processing: Personal information is processed exclusively for the purposes of processing and managing your Booking, administering your Stay, complying with our legal and regulatory obligations, communicating with you regarding your reservation, and — where opted-in — sending you relevant promotional communications from Plamedi Luxury Stay.
  • Third-party disclosure: We may share your personal information with trusted third parties solely as necessary to fulfil your Booking and deliver our services. This includes payment processors (PayFast, PayPal), booking platform operators, and service providers engaged in connection with your Stay. We do not sell, rent, or trade your personal information.
  • Retention: Personal information is retained for as long as necessary to fulfil the purposes for which it was collected, or as required by applicable law. Financial records are retained for a minimum of 5 years in accordance with South African tax legislation.
  • Your rights under POPIA: You have the right to request access to your personal information, to request corrections, to object to processing for direct marketing purposes, and to request the deletion of your information, subject to legal retention requirements. Requests may be directed to our Information Officer at privacy@plamedistays.com.
  • Marketing opt-out: Where you have opted in to receive marketing communications, you may withdraw your consent at any time by contacting us at the above address or clicking the unsubscribe link in any marketing email. Withdrawal of marketing consent does not affect the lawfulness of prior processing.
  • Full Privacy Policy: Our comprehensive Privacy Policy, which forms part of these Terms by reference, is available on our website at www.plamedistays.com/privacy-policy.

Intellectual Property
Ownership of content and brand materials
  • All intellectual property associated with Plamedi Luxury Stay and Plamedi Trading CC — including but not limited to the brand name, logo, website content, photography, property design, and marketing materials — is the exclusive property of Plamedi Trading CC. All rights are reserved.
  • Guests may not reproduce, publish, or commercially exploit any image, video, content, or material featuring or depicting Plamedi Luxury Stay properties without prior written consent from Plamedi Trading CC.
  • By sharing any photograph, review, or content referencing Plamedi Luxury Stay on social media or review platforms, you grant Plamedi Luxury Stay a non-exclusive, royalty-free licence to share or re-use that content for marketing purposes, with appropriate attribution to you as the creator.

Force Majeure
Circumstances beyond reasonable control

Neither Plamedi Luxury Stay nor the Guest shall be in breach of these Terms, or otherwise liable to the other party, for any delay or failure in the performance of obligations where such delay or failure results from a Force Majeure Event, including:

  • Acts of God, natural disasters, earthquakes, floods, lightning, severe storms, or wildfires.
  • Pandemic, epidemic, or public health emergency declared by national or provincial government, including associated travel bans, lockdowns, and movement restrictions.
  • Acts of government, changes in law or regulation, civil commotion, riot, insurrection, terrorism, or war.
  • Extended national infrastructure failures including prolonged Eskom load-shedding exceeding Stage 6, municipal water supply interruptions, or telecommunications network failures lasting more than 72 consecutive hours, provided that Plamedi Luxury Stay has exhausted all reasonable backup measures available to it.
  • Any other event that is genuinely unforeseeable, unavoidable, and beyond the reasonable control of the affected party.

In the event of a Force Majeure Event affecting a confirmed Booking, Plamedi Luxury Stay will endeavour in good faith to offer the affected Guest a suitable alternative date, a credit voucher, or — where neither is feasible — a partial or full refund as appropriate to the circumstances. Each Force Majeure situation will be assessed individually and on its merits.

Third-Party Platforms
Bookings made through Airbnb, Booking.com, and similar channels
  • Bookings made through Third-Party Platforms such as Airbnb, Booking.com, Expedia, or similar online travel agencies are additionally governed by those platforms’ own terms, conditions, and cancellation policies, which may differ materially from the policies set out in these Terms.
  • In the event of any conflict between these Terms and the terms of a Third-Party Platform, the terms of the Third-Party Platform shall govern with respect to payment, refunds, and cancellations processed through that platform.
  • Guests are encouraged to familiarise themselves with the relevant Third-Party Platform’s policies before completing a booking. Plamedi Luxury Stay accepts no responsibility for any terms imposed by Third-Party Platforms.
  • The house rules, conduct standards, check-in procedures, and all other operational terms set out in these Terms apply equally to all Guests, regardless of the channel through which their Booking was made.

Amendments & Severability
Updates to these terms and effect of invalid provisions
  • Plamedi Luxury Stay reserves the right to amend, update, or replace these Terms at any time. The most current version, bearing the effective date, will be published at www.plamedistays.com/terms. Amendments take effect from the date of publication for all new Bookings made after that date.
  • Confirmed Bookings made prior to any amendment will be governed by the version of the Terms in force at the time of Booking Confirmation, except where a change is required to comply with applicable law.
  • If any provision of these Terms is held by a competent court or tribunal to be invalid, unlawful, or unenforceable, that provision shall be severed from these Terms. The remaining provisions shall continue in full force and effect and shall be interpreted as if the severed provision had not existed.
  • No failure or delay by Plamedi Luxury Stay in exercising any right under these Terms shall constitute a waiver of that right. Waivers must be given in writing and signed by an authorised representative of Plamedi Trading CC to be effective.

Dispute Resolution & Governing Law
How disagreements will be handled

These Terms and Conditions are governed by and shall be construed in accordance with the laws of the Republic of South Africa, including the Consumer Protection Act 68 of 2008, the Protection of Personal Information Act 4 of 2013, the Electronic Communications and Transactions Act 25 of 2002, and the National Credit Act 34 of 2005 (where applicable).

  • Step 1 — Direct resolution: In the event of any dispute, complaint, or claim arising from a Booking or Stay, the Guest is requested to contact our management team directly at complaints@plamedistays.com. We undertake to acknowledge all complaints within 2 business days and to provide a substantive response within 10 business days.
  • Step 2 — Mediation: If the dispute is not resolved through direct engagement within 15 business days, either party may refer the matter to an independent, accredited mediator agreed upon by both parties. The costs of mediation shall be shared equally unless otherwise agreed.
  • Step 3 — Adjudication / Litigation: Disputes that cannot be resolved through mediation may be referred to the relevant consumer court, the National Consumer Commission (NCC), or a court of competent jurisdiction. The parties consent to the jurisdiction of the Magistrate’s Court of Johannesburg or the High Court of South Africa, Gauteng Local Division.
  • Consumer rights: Nothing in these Terms derogates from a Guest’s rights to approach the National Consumer Commission, a relevant consumer court, or any other statutory dispute resolution body established under South African law.
  • Online dispute resolution: In line with contemporary hospitality standards, Plamedi Luxury Stay also participates in good-faith resolution processes initiated through Third-Party Platforms where applicable to the relevant Booking.
